Privacy Policy
This Privacy Policy applies to personal information about you which we collect, use and otherwise process regarding your relationship with us as a customer or potential customer, including when you use our websites or mobile applications or book to use our services through any third party such as travel agents.
In this Privacy Policy, “personal information” means information which identifies you or may be used to identify you, your travel arrangements and purchase history and information about how you use our websites and mobile applications. In particular, we collect and retain your personal details (such as your name, date of birth, gender, nationality, travel document details, contact details) and the details of any individual who is travelling with you, your payment information, information about your travel arrangements, information in connection with a booking with us or a service you have requested from us, information in relation to your travel with us (such as your travel itinerary, hotel selection, choice of tours, car rentals), information about your use of our services and products, information about your interests, preferences and opinions, information about your health, biometric information, your online registration, use of our websites or mobile applications and your device and your location.
We collect personal information about you whenever you use our services. We may also receive personal information about you from third parties.
We mainly use your personal information to complete a booking you have made with us, to administer your travel arrangements and deliver the services you have requested, to keep track of you in advance of your flight, to manage the boarding process, to send status updates and service communications to you, to help keep you safe when you fly with us and to meet certain legal and regulatory requirements which apply to us, to facilitate flight connections, to carry out analysis and market research, to carry out marketing or advertising, to improve our websites, products or services or for management and administrative purposes. As a commercial airline and travel provider, we have a legitimate business interest to use the personal information we collect to offer an effective service and carry out our business. There are situations where we may need to use your personal information to protect the vital interests of you or another person or be subject to a legal obligation to use or disclose your personal information.
We may otherwise use your personal information with your specific consent. However, if you do not give your consent or withdraw your consent, in some circumstances, it may mean we will not be able to provide all or parts of the services you have requested from us and you will not be able to cancel your booking or obtain a refund of any charges you have paid.
The basis on which we are entitled to use your personal information includes (a) we need to use your personal information so that we can process your booking, fulfil your travel arrangements and otherwise perform the contract we have with you; (b) it is in our legitimate interests as an airline to use your personal information to operate and improve our business as an airline and travel provider; (c) we need to use your personal information to comply with a legal obligation; (d) to protect the vital interests of you or another person; and (e) you have consented to us using your personal information.
You may request us to stop using your personal information where we are doing so under legitimate interests unless it is needed for dealing with legal claims or we have other compelling legitimate reasons that override your rights, to stop processing of your personal information for marketing purposes, to stop sending you marketing communications and to correct the personal information that you have shared with us if that information is inaccurate. You may request for personal information which identifies you to be removed (anonymised), provided that we may need to retain certain elements that relate to a contract between you and us for our own legal and auditing purposes; we cannot erase your personal information if you have either flown with us in the past twenty four months or you hold a forward booking with us; we cannot erase your personal information if we have identified that you either have an open complaint with us or we held a previous case for you; and in some circumstances we may be unable to provide all or parts of the services you have requested from us. To do this, the information that identifies you will be removed our active systems. However, a separate and restricted copy of the identifying information will be kept to meet the obligations we may have to law enforcement, national authorities and legal proceedings. We will handle all requests in accordance with applicable law. However, depending on your request and the nature of the personal information involved, there may be legal reasons why we cannot grant your request.
We will keep your personal information for as long as we need it for the purpose it is being processed for. Your personal information may also be retained so that we can continue to improve your experience with us or to ensure that you receive any loyalty rewards which are due to you.
We will review the personal information we hold and delete it securely, or in some cases anonymise it, when there is no longer a legal, business or customer need for it to be retained. If you cease interacting with us as a customer, we may remove or anonymise your information.
Your choice
You may manage your cookie preferences and choose to block or allow essential cookies, analytics cookies, functional cookies or marketing cookies, or refuse to accept or disable cookies, by changing your browser settings, but bearing in mind that our website may not function properly without the use of some cookies.
Your personal information may be shared with the companies within our group. We share information with them so they can assist us in providing services to you and to understand more about you.
We may also disclose your personal information to customs, immigration, police, regulatory and government authorities; law firms, law enforcement agencies and law courts; other airlines and service providers, needed to deliver the services (such as car hire or hotel booking) you have asked for; credit and charge card companies, credit reference agencies and anti-fraud screening service providers to process payments and to carry out fraud-screening; service providers which provide services involving data processing (such as marketing or customer surveys); marketing agencies; or in compliance with a legal or regulatory obligation in any jurisdiction.
Your personal information may be sent to and stored by us and third parties at places outside Hong Kong to fulfil your travel or travel-related arrangements. In addition, we may transfer your data to parties at places outside Hong Kong to provide services to us. This may involve sending your data to places where under their local laws you may have fewer legal rights.
You may access the personal information we hold on you. If you wish to receive a copy of such information, you should make a request in writing and include the following information with your request:
- Your name and postal address
- Details of your request
- Corroborating information to establish your identity (such as a photocopy of your passport or driving licence)
- your signature and the date of the request.
When we have your permission we will send our marketing communications to you. Our marketing communications may sometimes include our business partners’ products and services. We will only allow third parties to send marketing communications to you when we have agreed marketing from third parties.
If you decide you no longer wish to be sent marketing communications, you may notify us any time. We aim to action requests to stop being sent marketing communications within twenty working days of receipt of your notification, but you may still receive some marketing communications during the period prior to that change being made.
Without prejudice to your rights under applicable laws, this Privacy Policy is not contractual and does not form part of your contract with us.
